Terms and Conditions

Welcome to the house rental website “Nomad House Benissa”. These Terms and Conditions govern the use of the website and the booking of a house through our platform. By accessing or using our website and/or making a booking, you agree to these Terms and Conditions in full.

1. Property of the House The house rented through our platform is owned by Nomad House Benissa and is located in Spain. The house is fully furnished and equipped with all necessary amenities for a comfortable stay.
2. Booking and Payment To book a house through our platform, a 10% advance payment of the total booking amount is required. The remaining payment must be made 10 days before the arrival date. We accept payments by bank transfer or credit card. If the full payment is not received by the due date, the booking will be cancelled and the 50% deposit will be forfeited.
3. Cancellations and Refunds In case of cancellation, the 50% deposit is non-refundable. If the cancellation is made less than 10 days prior to the arrival date, no refund will be given. If the cancellation is made more than 10 days prior to the arrival date, a 90% refund of the total payment will be given. If the guest decides to leave before the end of the agreed rental period, no refund will be given.
4. Use of the House The house may only be used by the number of people specified in the booking. Guests must comply with the rules of coexistence and respect the property. Smoking is not allowed inside the house, and the house is expected to be returned in the same condition as it was found. Any damages or missing items will be deducted from the security deposit. The guest is responsible for any damage caused to the property during their stay. Nomad House Benissa reserves the right to make additional charges for damage to the property.
5. Check-in and Check-out Check-in time is from 3 pm to 8 pm on the arrival date, and check-out time is before 11 am on the departure date. Late check-in or early check-out can be arranged subject to availability and may incur additional charges.
6. Guest Responsibility The guest is responsible for their own safety and the safety of their belongings during their stay. Nomad House Benissa is not responsible for any accidents, injuries, or losses that occur during the stay. The guest is also responsible for complying with all applicable laws and regulations during their stay.
7. Privacy Nomad House Benissa respects the privacy of its guests and will not share their personal information with third parties unless required by law. We collect and process personal data in accordance with the General Data Protection Regulation (GDPR).
8. Modifications to the Terms and Conditions Nomad House Benissa reserves the right to modify these Terms and Conditions at any time. The changes will come into effect immediately upon publication on the website. If you continue to use our website and/or book a house through our platform, you will be deemed to accept the modified Terms and Conditions.
9. Force Majeure Nomad House Benissa is not responsible for any delays, cancellations, or changes to the booking that result from circumstances beyond our control, such as natural disasters, acts of terrorism, or transportation disruptions.
10. Applicable Law and Jurisdiction These Terms and Conditions will be governed and interpreted in accordance with the laws of Spain. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Spain.
11. Security Deposit A security deposit of €500 is required upon arrival at the house. This deposit will be returned in full within 7 days of the guest’s departure, provided that no damage has been caused to the property or its contents. Any damages or missing items will be deducted from the security deposit, and the guest will be responsible for paying any additional costs if the security deposit is not sufficient to cover the damages.
12. Insurance The guest is strongly advised to take out appropriate travel insurance for the duration of their stay, including personal liability insurance. Nomad House Benissa does not accept any responsibility for loss, damage, or injury to the guest, their belongings, or third parties during their stay.
13. Housekeeping The house will be clean and tidy upon arrival, and a cleaning fee is included in the total booking amount. Additional cleaning services can be arranged at an additional cost. The guest is responsible for keeping the house clean and tidy during their stay, and for disposing of their garbage in the appropriate bins.
14. Pets Pets are not allowed in the house, except for guide dogs for guests with disabilities.
15. Noise and Disturbances The guest must respect the peace and quiet of the surrounding area, and must not cause any disturbances or nuisance to the neighbors. Loud music, parties, and other activities that may cause disturbances are strictly prohibited.
16. Non-Smoking Policy Smoking is strictly prohibited inside the house. If the guest smokes inside the house, a cleaning fee of €250 will be charged to cover the cost of cleaning and sanitizing the house.
17. Termination of Stay Nomad House Benissa reserves the right to terminate the guest’s stay if they breach these Terms and Conditions or engage in behavior that is deemed to be inappropriate or illegal. In such cases, no refund will be given.
18. Indemnity The guest agrees to indemnify and hold Nomad House Benissa harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising from their stay in the house, including but not limited to any breach of these Terms and Conditions or any damage caused to the property or its contents.
19. Intellectual Property The content of the website, including but not limited to text, graphics, logos, images, and software, is the property of Nomad House Benissa and is protected by intellectual property laws. The guest may not copy, reproduce, distribute, or use any content from the website without the express written consent of Nomad House Benissa.
20. Entire Agreement These Terms and Conditions constitute the entire agreement between the guest and Nomad House Benissa regarding the use of the website and the booking of a house through our platform, and supersede all prior agreements and understandings, whether written or oral.
